ヨルダンで上院議員が大量に辞表提出

憲法改正の一つに、「閣僚・議員の二重国籍を認めない」とする改正点があり、そのため、該当者が辞表を提出している。上院議員は国王による任命制。

新しい憲法の規定では、上院に空席が生じた場合、国王は1ヶ月以内に後任を任命しなければならない。現行憲法では2ヶ月以内である。

外国籍を捨てる人もいるが、任命時に二重国籍だったので、厳密には違憲になる。

AMMAN - More senators holding dual nationalities on Thursday submitted their resignations in compliance with the new Constitution, which prohibits Jordanians who have another nationality from holding ministerial, senatorial and parliamentary posts.

Senators Muhammad Hamdan and Abdul Hamid Shoman submitted their resignations to Senate President Taher Masri.

Their peers Talal Abu Ghazaleh, Khaled Sharif and Suhair Al-Ali also resigned earlier this week for the same reason.

Under the amendments made to Article 75 of the Constitution, which went into effect Saturday, "no person can become a deputy, senator, minister or a high-ranking official if he/she holds dual nationality".

Masri confirmed the resignations in a telephone interview with The Jordan Times Thursday. "With these new resignations, I think there are no Upper House members now holding dual nationality," he said.

The veteran statesman pointed out he sent an official memorandum to the concerned authorities regarding the vacant seats. Senators are appointed by Royal Decree.

According to Article 36 of the Constitution: "The King appoints members of the Senate and appoints the speaker from amongst them and accepts their resignations."

Masri added that under the new amendments to Article 88 of the Constitution, vacant seats of senators should be filled within one month and not two months as the original Constitution stipulated.

After the amendment, the article now reads: "When a seat becomes vacant in the Senate or in the Chamber of Deputies by death or resignation or for any other reason, it shall be filled by appointment in the case of a senator and by the holding of a by-election in the case of a deputy within one month from the date on which the government is notified of the vacancy by the House. The term of the new member shall be for the remaining part of the term of his predecessor."

By the time the amended Constitution went into effect, several ministers, senators and MPs started rectifying their statuses by either submitting their resignations or relinquishing their non-Jordanian nationalities.

The first to resign was Abu Ghazaleh as he holds Bahraini citizenship, along with his Jordanian nationality.

Minister of Water and Irrigation Muhammad Najjar and Minister of Culture Jeryes Samawi on Monday applied to relinquish their non-Jordanian nationalities, reportedly Russian and American, respectively, at the concerned embassies.

On Wednesday, Deputy Emad Bani Younes (Irbid, 6th District), announced that he submitted an application to the US embassy in Amman to relinquish his American citizenship.

However, former justice minister and constitutional expert Muhammad Hammouri explained that even if ministers, senators or MPs holding dual nationality, abandon their other nationalities, their posts remain "unconstitutional" because they held dual citizenship when they were appointed or elected.

In addition, Hammouri explained that ministers, senators and deputies are appointed or elected according to the Constitution that sets the conditions of their posts and their duties and not according to a contract regulated by laws, noting once the new Constitution is published in the Official Gazette, it has the supreme legal force over all other laws.
