A bill tabled by George Gilkinet (Ecolo) and Stefaan Van Heecke (Groen!) On the lifting of bank secrecy, has also received a favorable opinion of the State Council, said the MP George Gilkinet.

Like the bill tabled by MP sp.a Dirk Van der Maelen, and received a positive opinion of the State Council, the Greens' proposal includes one of the priority recommendations of the Commission to Survey of tax fraud to relax the conditions under which bank secrecy may be lifted by the tax authorities.

In his opinion, the Council of State considers that the proposal is "constitutional and proportionate", while "just asking a few minor adjustments," said MP environmentalist.

"In any event, the green light from the Council of State must allow progress on this first legislative decision following the work of the inquiry commission, whose work was concluded last May and still awaiting a first practical and legal translation, more than 7 months later, George still believes Gilkinet.

The Council of State (Legislation Section) has an opinion on a bill aimed at easing bank secrecy in our country.
According to the State Council, this bill does not affect the privacy of taxpayer so "disproportionate", said Sunday the website Tijd.

The bill in question was filed by the member sp.a Dirk Van der Maelen but takes much of the conclusions issued by the Commission to investigate tax evasion.
All parties, except the Lijst Dedecker and N-VA had approved the findings of this Inquiry.

The bill gives tax authorities the opportunity to receive information from banking institutions, currency, credit and savings on a person or entity suspected of evading tax .
The taxpayer concerned shall be notified a month after his accounts were scrutinized.

In his opinion, the State Council finds that the right to respect for privacy is not absolute.
An infringement of the right to respect for private life is permitted in cases of "pressing social need", as the fight against tax evasion.
This achievement is not "disproportionate", said the State Council.

The State Council gives go ahead for a relaxation of conditions for the lifting of banking secrecy in order to fight against tax evasion.
Called to render an opinion on a bill, the State Council said that there was no disproportionate interference with privacy.

The law provides sufficient safeguards to prevent it from being too damaged to privacy and family.
The State Council and validates the method proposed by the Socialist deputies Dirk Van der Maelen and Alain Mathot fight against tax evasion.

They propose to relax the conditions for the lifting of bank secrecy by changing the tax code.

Specifically, access to bank customers remain packaged.
But in some cases, the administration will ask the banks according to a flexible criterion: where there is a presumption that the tax due is greater than reveal the declared income.
